Lotherton Membership Terms and Conditions
These are the terms and conditions applicable to members of Lotherton (“Terms”) †. In these Terms, “you/r” refers to the member of Lotherton (or applicant for such status), and “we” and “us” refers to Lotherton.
1. Benefits of being a member
1.1 As a member you are entitled, upon presentation of a valid Lotherton membership card, to free entry to Lotherton during normal opening hours and subject to the usual conditions of entry and the exceptions listed in section 3.
1.2 Additional membership benefits including entry to some events are set out on the Lotherton website.
1.3 With the exception of entitlement to free entry to Lotherton in accordance with paragraph 1.1, we reserve the right to change benefits without prior notice for any reason.
2. Visiting as a member
2.1 Members should remember to bring their Lotherton membership card with them when they visit. Members who are unable to show a valid membership card on entry may be required to pay non-refundable entrance fees before they are admitted.
2.2 ‘Individual’ membership allows only the named card holder to enter Lotherton. ‘Individual’ membership is further separated into ‘Adult’ (aged 16+) and ‘Junior’ (ages 3-15). ‘Joint’ membership allows both named card holders to enter Lotherton, either together or individually. ‘Family’ membership categories allows the adult(s) named and up to 3 children (ages 3-15) to enter Lotherton. Under 3s are free.
2.3 Memberships, membership cards and any associated benefits are non-transferable and can only be used by the named Member(s). Proof of identity may be requested on presentation of your membership card at Lotherton.
2.4 Lost or damaged membership cards will incur a replacement fee. Replacement cards can be picked up from the Membership Office on your next visit.
3. Events and exceptions
3.1 Being a member does not entitle you to free entry at ticketed events, nor does it guarantee the availability of tickets to any such events.
3.2 Guest passes may not be used to gain access to Lotherton on event days.
3.3 Opening times may vary when a public or private event is held at Lotherton. It is advisable to contact Lotherton before travelling.
3.4 Where a maximum number of visitors applies pre-booking may be required and admittance will be strictly on first-come first-served basis.
4. Term
4.1 Lotherton membership is valid for twelve (12) consecutive months. If you cancel or are unable to use your membership at any stage during this time, refunds or extensions will not be offered in any circumstances and any outstanding balance will be payable in full.
5. Membership application process
5.1 Memberships (new and renewals) may take up to 28 days from receipt to process and membership materials should be collected on your next visit.
5.2 Memberships should be managed via the online portal.
5.3 All membership correspondence is via email. If an email address is not available we will contact you via post with essential information only.
5.4 Conversion from ‘day ticket’ to membership within 30 days of your day ticket visit permits a like-for-like refund against the day ticket price(s). ‘Individual’ members will receive the equivalent adult or junior entry price refund per membership, ‘Joint’ holders will receive a refund to the equivalent of x2 adult day tickets, ‘Family 1 adult’ will receive a refund to the equivalent of x1 adult day ticket and up to x3 children, ‘Family 2 adults’ will receive a refund to the equivalent of x2 adult day tickets and up to x3 children.
6. Refund policy
6.1 Where you apply for Lotherton membership via online application or by telephone you have a legal right to change your mind within 14 days of the date of application and receive a refund of membership fees paid; provided that if you have visited Lotherton within that period you shall be liable to pay the applicable entry fee in respect of such visit(s). Please note no refunds will be given for redeemed gift of memberships. To request a refund please notify the Lotherton Memberships team by email, phone or letter within 14 days of receiving your membership pack. No refunds will be issued after this time. Contact details can be found in section 14.
7. Price information
7.1 All quoted fees are for a one-year (12 month) membership.
7.2 We reserve the right to increase the price of your membership subscription on an annual basis. You will be informed of any fee increase within your renewal correspondence.
8. Card information
8.1 The credit/debit card information you provide us for a membership transaction is used solely for the purpose of processing that membership transaction. If we are unable to process payment from the credit/debit card details you have provided we will contact you immediately to verify your card details.
9. Changes in membership details
9.1 If you wish to make changes to your membership details during your current subscription please log in to your online membership portal to make the relevant changes. This includes changes to personal details and membership type. No new cards or refunds will be issued. If you wish to add a member, we will ask you to pay the difference and issue the new card(s).
10. Membership renewals
10.1 We will contact you via email approximately one month before your Membership is due for renewal, detailing the expiry date of your current Membership and any further actions you may need to take to continue your subscription.
10.2 Members who have payment arrears on a previous Lotherton membership cannot take out a new membership until the arrears have been paid.
11. Promotions
11.1 Offers and discounts cannot be used in conjunction with any other promotions.
11.2 All promotions and news will be sent via email.
12. Further conditions
12.1 We reserve the right to refuse entry and/or Membership and/or to revoke Membership without refund if the Member behaves in a threatening or abusive manner towards any person at Lotherton, or damages or threatens to damage any of the collections or property of Lotherton, or acts in a manner which could bring Lotherton into disrepute.
12.2 We reserve the right to revoke your membership at any time, without financial compensation, if you commit any breach of these Terms.
12.3 We reserve the right to review and/or alter these Terms at any time. Notices will be displayed at Lotherton and, where an email address has been provided, they will be sent by email, otherwise they will be sent by 2nd Class post.
12.4 Lotherton accept no liability at all for loss, damage or disappointment you may suffer arising out of your membership of the scheme except where such loss, damage or disappointment has arisen through any breech of the councils terms of the scheme.
12.5 These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with, the law of England and Wales.
13. Privacy statement
13.1 The information you provide on your application form will only be used to administer your Lotherton account and to provide you with service information relevant to your membership.
13.2 Your details will be held in accordance UK Data Protection legislation. We may share information with other people and organisations where we are required by law to do so, or with appropriate justification under this legislation. This includes where disclosure is necessary to enable the council or another organisation to exercise its statutory functions (for example, the Department for Work and Pensions or the Police).
13.3 Your Lotherton account is administered using a database system provided by our service partner, Leeds Ticket Hub, which uses a CMS called Tessitura. Information you provide to the Council will be processed on Tessitura’s systems as well as on our own. All information provided by the Council to Tessitura for processing will adhere to industry standard data transfer protocols and all data will be encrypted. Tessitura have access to our database and the personal information contained within it for administrative and maintenance purposes only. Tessitura will not share this with any third parties.
13.4 The Council also uses an email marketing partner, Wordfly, to assist in the provision of this service. Information you provide to the Council will be processed on Wordfly systems as well as on our own. All information provided by the Council to Wordfly for processing will adhere to industry standard data transfer protocols and all data will be encrypted. Wordfly will not share this with any third parties.
13.5 We may also use your data to produce statistics about how our services are used. We do this so that we can improve the services.
13.6 All the personal data you provide as part of your application will retained for the length of your membership, and for up to 24 months after your membership ends. After this point, it will be securely destroyed.
13.7 Details of your rights under UK Data Protection Legislation, including details of the Council’s Data Protection Officer, your rights as a Data Subject, and your right to complain to the Information Commissioner’s Office are available in this privacy notice page.
